In compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, its Regulations and the Privacy Notice Guidelines, PRODUCTOS PENNSYLVANIA, S.A. DE C.V., (the “Responsible”), with address at Camino a San José 1, San Pablo Tecnológico, C.P. 76150 Santiago de Querétaro, Querétaro, Mexico, puts this Privacy Notice (the “Notice”) is responsible for collecting the information provided by the holders of personal data for the purposes of the services that this company offers to the general public. This information will be treated as strictly confidential, as well as the use and protection given to them and to comply with the above makes available to any natural person (the “Holder”) in respect of which it treats their personal data. This privacy notice may be consulted on the web page https://www.pennsylvania.com.mx/en/ and/or at the address indicated above.

I. PURPOSES

The Responsible may process the personal data of the Holder for the following purposes:

 

  • Customers: (i) to provide the products or services required by the Holder; (ii) to make changes or repairs to the products purchased by the Holder; (iii) to fulfill the obligations contracted with or by the Holder; (iv) to integrate a customer file; (v) to place orders by any agreed means; (vi) to inform about news and novelties, promotions, points of sale, support materials and to provide technical assistance; (viii) To provide information related to invoicing, delivery of products, account statements and collection; (ix) To conduct surveys to determine the quality of the products and services provided; (x) Including all matters related to customer satisfaction, after-sales service, supplier warranties and other similar matters. (xi) In general, for the due fulfillment of the commercial operations existing between the Holder and the Responsible.
  • Employees: (i) to carry out the personnel selection and recruitment process; (ii) to integrate the Registrant ‘s labor file in case of hiring; and (iii) to comply with the benefits and obligations derived from the labor relationship with the Registrant.

In cases where the Responsible intends to process personal data for a purpose other than those contained in this Privacy Notice, the Responsible undertakes to inform the Holder and obtain his or her consent for the new processing.

 

In addition, we will use your personal information for the following purposes that are not necessary, but which allow us to provide you with better service: sales, after-sales service; information about our products: news, updates, promotions; points of sale, support materials, technical advice, training, warranties, and quality surveys.

II. PERSONAL DATA.

The Responsible may collect the following personal data from the Holder:

 

  • Customers:
    • ID / Contact / Patrimonial / Financial: name, address, email, telephone number, cell phone number, bank account numbers, autograph signature, as well as Federal Taxpayers Registry (RFC).
  • Employees:
    • ID / Contact / Academic / Labor / Patrimonial / Financial: name, address, e-mail, telephone number, telephone number, cell phone number, autograph signature, Federal Taxpayers Registry (RFC), Unique Population Registry Code (CURP), level of studies, title, professional license, position, labor references, social security number, credits contracted with governmental entities (INFONAVIT or FONACOT) and bank account number.

The personal patrimonial or financial data of the Holder will be collected only when it is necessary to comply with the obligations arising from the relationship that the Holder has with the Responsible.

 

The Responsible states that for the purposes indicated in this Notice, it does not collect sensitive personal data of the Holder.

III. CONSENT.

The consent of the Holder for the processing of his/her personal data in accordance with the terms of this Notice is deemed granted when the Holder: (i) does not express any opposition once this Notice has been made available to him/her; (ii) expressly states so; and/or (iii) has a current relationship with the Responsible.

IV. TRANSFERS.

The Responsible declares that the personal data of the Holder will not be transferred to third parties in any case, unless the transfer is necessary for the fulfillment of the obligations arising from the legal relationship it has with the Holder; or any of the exceptions provided by Article 37 of the Federal Law for the Protection of Personal Data in Possession of Individuals.

V. RIGHTS OF THE HOLDER (ARC).

The Holder has the right to: (i) access their personal data and know the treatment given to them; (ii) rectify their personal data in cases where the information is inaccurate or incomplete; (iii) cancel their personal data when it is not required to carry out the purposes stated in the Notice; (iv) oppose the processing of your personal data for specific purposes; (v) revoke your consent to the processing of your personal data; and (vi) limit the use or disclosure of your personal data.

To enforce any of the rights set forth in the preceding paragraph, the Holder must submit a written request to the address of the Responsible or to the following e-mail address datospersonales@pennsylvania.com.mx, which must contain: (i) name and address of the Holder; (ii) document that proves the identity of the Holder or the documents that prove the representation of the same; (iii) a clear and precise description of the personal data with respect to which he/she seeks to exercise any of the rights indicated in the preceding paragraph; as well as, (iv) any other element that facilitates the identification of the personal data, and if applicable, exhibit the documentation that supports the origin of the corrections requested.

The Holder request will be handled by the Responsible personal data protection department, which must respond within a term of 15 (fifteen) business days from the date of submission of the request, which term may be extended for 10 (ten) additional days upon prior notice. The answer will be sent to the address or e-mail indicated by the Holder. In the cases in which the Holder exercises his right of access to information, the Responsible shall comply by making the personal data available to the Holder, issuing simple copies, electronic documents or any other means that allows the Holder to access his personal data.

In addition to the above, in the case of requesting: (i) rectification, you must additionally indicate the modifications to be made and provide the necessary official documentation to support your request; (ii) cancellation, you must express the causes that motivate the elimination; and (iii) in the right of opposition, you must indicate the reasons that justify the termination of the processing of personal data.

VI. MODIFICATIONS.

The Responsible reserves the right to make changes and/or updates to the Notice at any time, in response to new legislative provisions and new internal policies, which will be available at the address of the Responsible.
